All of our working lives have suddenly changed. However, one thing we can be sure of is that people will keep having accidents whether accidental or where blame can be attached to someone. For some this may be an accident at work.
Lisa Walton, a solicitor in our Personal Injury Team, looks at how the restrictions applied to our everyday lives will be effected if you have an accident at work.
When working arrangements have changed, you must make sure you understand any changes that have been made fully, so that you continue to work safely.
Are You Working from Home?
If you are working from home, you need to treat the space as your new working environment. This means considering the risks of that space in the same way you would if you were still in your usual work space.
- Are the computer wires tucked away to prevent a tripping hazard?
- What is your sitting position like?
- Is your monitor positioned correctly?
- Are you taking enough time away from your desk?
Have a think about your health and safety generally, seek advice from your employer if unsure and don’t forget to check your house insurance to ensure it covers you for working from home and any equipment you have brought home with you.
Are you going out of your home to a place of work?
If you are still going out to work during the outbreak you need to ensure you follow the Government guidelines on hand washing and social distancing as well as any specific guidance given by your employer. You can see these again by clicking here.
If you are still going out to work and have an accident that was no fault of your own. We are here to discuss that incident with you and consider whether you have a potential claim.
Simply because there are Government Restrictions in place due to COVID 19 does not mean that an accident you have during this time is any less serious or that your claim is less likely to be successful. Employers have insurance in place that covers their employees.
If you have an accident due to your new working environment again do not be put off discussing the scenario with someone as you still might be able to make a claim even though the incident happened in your own home.
Accidents do happen
Your employer has a duty of care to ensure your safety whilst at work. If they breach that duty to you in some way and you sustain an injury as a result you could be able to make a claim. Claims help people get the justice they deserve when something was not their fault, or in many cases help make ends meet if you are unable to work.
If you had an accident at work that was not your fault, which took place within the last 3 years now could be the time to consider getting that claim investigated. You may have more time on your hands as you are at home more, so it could be a good time instruct someone to investigate that accident for you.
